General terms and conditions of business
The following general terms and conditions regulate the business relationship between Ruth/Schäfer GbR (seller) and the visitors or customers (buyers) of the Ruth/Schäfer GbR online offering.
1. Terms of Use of the Seller's Online Offer
The Ruth/Schäfer GbR online offering is available to all visitors to provide information about the production program. *
The option of ordering online is only available to registered customers.

Orders placed by the buyer are deemed to be confirmed and accepted upon delivery or with a written order confirmation. By placing an order and registering as a customer, the buyer accepts our general terms and conditions, even if his own terms and conditions may conflict with them.
3. Price and delivery conditions
The prices and offers stated are subject to change, in EURO, plus statutory VAT.
Delivery takes place ex works Bochum, at the purchaser’s expense and risk.
Shipping will be carried out by post or parcel service at our discretion. Costs for express shipping are always borne by the buyer.
Any transport damage must be reported and claimed to the transport company immediately after receipt of the goods.
4. Shipping costs within Germany
Depending on the payment method and transport route, the following shipping costs apply:

The post office charges a cash on delivery fee of 2 euros per parcel
Payment in advance or by credit card (MASTER or VISA card) = postal package = free shipping.
For the shipping methods parcel service, forwarding agent and EXPRESS, different shipping costs apply depending on the weight of the shipment. The seller will inform the buyer of these shipping costs in writing (letter, fax or email); the goods will only be shipped after written confirmation from the buyer.
5. Shipping costs outside Germany
When goods are shipped outside of Germany, different shipping costs apply depending on the transport route and weight of the shipment. The seller will inform the buyer of these shipping costs in writing (letter, fax or email); the goods will only be shipped after written confirmation from the buyer.
6. Terms of payment
Payment is made cash on delivery or in advance by bank transfer, PAYPAL or MASTER or VISA card.
7. Delivery time
Delivery will be made as quickly as possible.
For items from the Ruth/Schäfer GbR online shop, delivery takes place within approximately 3-5 days.
Delivery dates confirmed by us are always estimated delivery dates and apply to delivery ex works. Fixed dates only apply after express confirmation.
8. Non-fulfillment
The items and offers offered are non-binding; if delivery is not possible, the seller reserves the right to withdraw from the contract at any time. In the event of withdrawal from the contract by the seller and in the event of a delay in delivery due to force majeure, weather conditions or other adverse circumstances, no claims for compensation or other rights can be asserted.
9. Complaints
Complaints about obvious defects must be made within 8 days of receipt of the goods. The complaint can only be processed and accepted if the item in question is presented or sent in the original packaging.
10. Right of withdrawal (only for non-commercial customers)
When purchasing food (chocolate, pralines, marzipan, etc.) and food additives, the right of return and cancellation according to §312ff BGB are excluded according to §1 Paragraph 3 No.5 FernAbG. Otherwise, non-commercial customers have a 14-day right of cancellation from the day of delivery. For goods worth less than 40 EURO, the buyer bears the return costs. If the right of cancellation is exercised, the seller charges the buyer the value of the use of the goods at 10% of the value of the goods.
11. Retention of title
The delivered goods remain our property until full payment has been made. The retention of title also extends proportionately to the proceeds generated from our goods until full payment has been made.
12. Changes and deviating agreements
We reserve the right to make changes to our product range. Deviations from these terms and conditions are only valid after written confirmation.
13. Place of performance
The place of performance and jurisdiction for both parties is Bochum. German law applies, excluding international sales laws.
14. Nullity
Should one or more provisions of these general terms and conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. Rather, in such a case, the contracting parties undertake to replace them with a valid or enforceable provision that corresponds as closely as possible to the spirit or purpose of the provision to be replaced.
